I chose to highlight these three major gun laws because they are the ones most likely to catch someone off guard that has no idea they are in violation of the Washington, DC gun laws.

Legal Insurrection hasn’t gotten an answer back from NBC on their violation of DC law as of this update. It sure is inconvenient for NBC that David Gregory not only stated it was “a magazine for ammunition that carries 30 bullets”, but that subject matter expert NRA CEO and executive VP Wayne LaPierre was two feet away to witness it in person.
Update 3: There’s now a White House petition to press charges against David Gregory. The DC police might want to actually look into this rather than just brush it off, too. If NBC’s smuggled in an illegal magazine, who knows what else they have in their studios? If NBC has a weapon to go with that magazine in their studio in DC and somebody walks off with it and it’s involved in a crime, the DC police are going to have a hard time saying they couldn’t do anything to prevent it and keep their “Gun Free Zone” safe. NBC would have an even harder time. Imagine the lawsuits.
Update 4-5: CNN’s Don Lemon said something last night (12/22/12) about buying an AR15 rifle for himself in Colorado and then complained about how it took longer at the DMV to get his license than it did to buy the gun. It looks like he may well have broken Colorado gun laws by buying that gun.
LEMON: OK. And I told you last week that I have an ar-15. And the reason I have an ar-15 is during the Colorado theater shooting, I told you as well. I want to know what I’m talking about when it comes to how, you know — what this person did, if he went in, how long it took him to get a gun, and ar-15.
I went gun store until Aurora, Colorado. It took me longer to get the identification that I need to buy that gun than did for me to buy the gun, and the ammunition. It took me 20 minutes. And that’s what — that was over nervous chatter what do I do? I don’t know anything about this.
He’ll probably find a lot folks in agreement with that very last statement, especially since it looks like he may have illegally bought a gun by violating the Colorado gun laws listed below (and by extension, also federal laws).
If he still lives in Atlanta, Georgia where his bio says he’s based, then he violated Colorado gun laws. Those who may buy long guns are listed in statute as such:
12-27-101. Legislative declaration – nonresident.
(1) It is declared by the general assembly that it is lawful for a licensed importer, licensed manufacturer, licensed dealer, or a licensed collector (licensed under the federal “Gun Control Act of 1968”) whose place of business is in this state to
sell or deliver a rifle or shotgun to a resident of a state contiguous to this state, subject to the following restrictions and requirements:…
12-27-103. Definitions. As used in this article, unless the context otherwise requires: (1) “A state contiguous to this state” means any state having a common border with this state.
The ATF generally treats “contiguous states” as the lower 48, unless defined otherwise by the individual state, like Colorado specifically does by saying “common border”. In this case rather than limit just where Coloradans can buy (as per the ATF example), the state statute limits which residents of other states can or cannot buy long guns in Colorado.
COLORADO
Residents: May purchase long-guns only in Arizona, Kansas, Nebraska,
New Mexico, Oklahoma, Utah and Wyoming 3,4Nonresidents: May purchase long-guns in this state only if they are a resident

Even if he’d just moved to Colorado, Colorado.gov says you have to reside in the state for 90 days to have residency (unless you own or operate a business or are employed in Colorado, which probably doesn’t apply if you live and work in Georgia). So he may be violating the law by buying a gun when he’s ineligible, even if he just moved to Colorado and got a driver’s license.
Goes to show once again that we have plenty of gun laws. We just need to start enforcing them against criminals, rather than going after law abiding citizens with more laws that criminals and madmen certainly will never follow and will never be effected by. There may now be two very public examples that could be used to show why you shouldn’t violate gun laws.

Gergory should be considered an “assault weapon” for the inquisition-like attack he launched on LaPierre on Meet the Press. His semi-auto attack was so sustained that he somehow forgot the inconvenient fact that the program he was castigating LaPierre for suggesting is the very same program Bill Clinton spent tens of millions of tax dollars on (“Cops in Schools”) for which Clinton took a victory lap on the one year anniversary of Columbine. BTW, the “armed guard” at Columbine admitted he was off-site eating when the shooting started, and that he fired on the killers with a pistol from 60 yards away. That is NOT the concept presented by LaPierre.
It’s hard to judge the effectiveness of the ban when the ban is so local. DC bans high-cap magazines, but most adjacent states do not. So a DC resident can legally purchase a high-cap magazine with only a short jaunt to a neighboring state. Transporting the magazine into DC is illegal. What the example shows is that bans are much less effective when non-ban areas are nearby and the border between the ban and non-ban area is weakly policed. But that’s hardly news.
Ah, so the ban must be inescapable. Everything must go, then when only the government has guns, of course we’ll be safe.

I chose this one comment to specifically highlight the sheer hypocrisy of the gun lobby. Apparently, David Gregory has earned the hatred of gun fanatics for the mortal crime of daring to ask tough questions during a national interview. Of course, we will set aside the fact that he asked those tough questions because that is specifically what the Constitution expects of him, for the betterment of society through free and open debate. Apparently, the NRA is afraid of that. It fears debate and is terrified enough of tough questions that it will call for the arrest of anyone who asks them.
Clearly, you people could give a rat’s ass about “constitutional rights.” You could care less about them. All you care about is protecting your cute little hobby, the Constitution be damned. Thank you for showing the public at large your true face.
Freedom is not a hobby.
David Gregory is being called out on his rank hypocrisy. He demands more laws, but he breaks the ones he demands more of.
The Constitution enshines the Second Amendment specifically to resist tyranny. In the long run, it’s more important than the rest, because it physically preserves the rest. The beauty, as Thomas Jefferson said, was that it won’t ever be needed unless government tries to take it.
David Gregory is using his First Amendment right to attack the Second Amendment, to demand unconstitutional restrictions on a right that is stated “SHALL NOT BE INFRINGED”. His position is already taken by some elements of government. There are unconstitutional gun laws already on the books – like the one he is violating on tape.
He wants to restrict your rights and mine and he violates the law in order to stand on his soapbox.
If he wants to live under the laws he proposes, he should be arrested and he should live under them. If he suddenly realizes that he’s broken a stupid law, and that he shouldn’t want the law, then good for him. Then I’ll support him in his fight against 2A infringements and his own imprisonment.
But he won’t. That’s why many people want to see him arrested.
Not because he opposes the NRA, but because HE VIOLATES LAWS HE SUPPORTS.
“Freedom” clearly is a hobby when it’s only a priority when it conveniences you. The gun lobby clearly does not care about the Constitution, as demonstrated by its irrational vindictiveness against a journalist merely for asking tough questions. This is about protecting gun revenues and a fun hobby. Not “freedom.”

He should be arrested and prosecuted to the fullest extent of the law. That means the NBC offices in DC need to be the subject of a search warant to seize the tapes of the show and any other evidence of a crime. More than one upstanding Ameican has run afoul of of this Nazi style gun control law, what makes this progressive worm deserving of different treatment. This is further evidence of the breakdown of the rule of law, and the fallacy of equal treatment under the law. Further someone at NBC and I doubt it was Gregory, transported the offending piece of metal into the Distict they to need to be found and punished along with eveyone on the set that failed to report the violation they are all complicit as acessecories to the crime, and at the very least need to be arrested and investigated just like anyone else who happened to be in one of the the cars harrassed by the DC police would be, when passing through the hell hole while traveling to their new home, in the past few incedents.

There is no question he violated the law and should be held accountable as would any other. Ignorance of the law is NO excuse as we know. His little show-n-tell in his attack on the 2nd Amend. is certainly not acceptable. A fine and 30 days would set an example to others. Wash. DC takes their severly restrictive gun laws very seriously which is why gun crimes there are so rare. Davie could use the experience for a book or something, maybe even find a new “friend” or even a life partner.

Yes, David Gregory broke the laws of Washington DC and should be arrested immediately.
Do facts matter at all in this debate? If I thought gun control worked I would probably su[pport confiscation, but the truth is gun contro is an abject fail;ure. First, gun violence in the US is at an all time low, so the rationale for confiscating or limiting gun ownership is faulty. Second, we have had terrible massacres while the last “assault weapon ” ban was in place. Third, CT has some of the strictest gun laws in the US and they did nothing to stop the Newtown massacre. Fourth, is a killing via poison, fire or knife any less horrible than by a gun? Fifth, tyrants all over the world ban guns, not to control violence but to restrict citizens ability to protest their horrors.
Improving mental health policies will clearly help, in addition to making life better for “troubled” perople who truly need medication. And although I am not especially religeous, bringing God back will clearly help too. What clearly will not help is politicians “not letting a crisis go to waste”.
It’s a good thing that magazine didn’t kill anyone. Close call!

Laws of this sort only apply to ordinary people, I.E. law abiding citizens. Criminals, news people, celebrities, sports figures, and politicians are exempt from obeying these laws.
Nothing will happen. Mayor Bloombutt has been violating Fed/State gun laws for decades, sending out strawman gun buyers, and the ATF and FBI has ignored it.

The statute probably defines “possess.” If it’s not defined in a statute, then by normal legal definitions, simply holding something, which is what Gregory did, is not possessing it. Legal “possession” is not like “possessing” a catch before you go out of bounds. Possession under the law implies at least a type of ownership.

Since they are so hot for gun laws to be enforced arrest and prosecute them. I contacted the DC Metro police with a link to the story, the video is evidence enough of the crime, all who agree should urge his prosecution too. I just found out about a law that was passed a long time ago called the Dick Act of 1902 that is an interesting law everyone should read.
Of course, you all are ranting as if you KNOW the facts, but you don’t. For all you know, it was an empty metal case, incapable of holding any rounds. It might have been real, it might not. But again, you have NO IDEA. As is so often the case, you open your pie hole before the brain is fully engaged, your bloodlust against the perceived “liberal media” all consuming. I’m not sure where the blood is rushing (actually I do have a good idea), but it’s not to your brain.
How about putting some “common” into “common sense” and ask yourself if there’s any alternative to your postion before you go off on your rant. How about actually THINKING something through rather than just believing what you’re told by your conservative talking-point overlords. You conservatives have some very meaningful things to say, but your message is lost in the volume (both number and sound level) of your tirades. It grows tiresome and quite frankly, it takes too much energy sifting through your hate-filled speech to ferret out the meaningful points you’re trying to make.
More is accomplished through dialogue, but I’m sure this post will be met with ad hominem attacks, calling me a “libtard” or other such derogative terms. I’m actually not liberal, but since I call into question the way in which you deliver your message… there will be some who feel as though they must attack me as such.
Time to dismiss the invective and quit being lemmings to the likes of Hannity, Limbaugh and other’s who try to get you to do THEIR bidding. If you know anything about the AR market, it’s a lot harder to find a fake magazine than a real one (even with the massive buying of the last week or so), and even a prop magazine that just used the magazine body (“empty metal case” as you say) would still fall under the section of DC law that says “can be converted”.

After Meet the Press, a CNN commentator said that news hosts were going too far into advocacy and activism and attempted political agenda promotion and name-calling. He did not charge that David Gregory’s adamant and animated use of an actual gun clip with LaPierre was an instance of this going too far; he certainly suggested the interview as a whole was going too far. He certainly agreed that the use of words like “Nut” and “Whacky” by two New York newspapers was beyond the role of journalism in its useless ad hominem approach.
Note that what some news hosts and reporters immediately called absurd–armed guards in schools–is not only what President Clinton brought forth, but was praised as a good approach by the Hispanic Democratic mayor of Los Angeles when he stated immediately after the original LaPierre interview that such armed guards are part of the Los Angeles approach. Nor did hosts give the actual figures on the substantial number of schools in the nation that now have such armed guards.
Recalling that general reprimand on CNN for violation of journalistic ethics by advocacy and activism, recall how Howard Kurtz attacked Andrea Mitchell for her crossing that line regarding her attacks on Kamen, a campaign in which she was successful and then used similar terms and tactics, along with other MSNBC personnel, to attack the US bishops for not wanting to be forced to pay for sterilizations, contraception, and abortion-inducing pills.
Not surprisingly, Andrea is very strident on gun control on the Christmas Eve Morning Show. She is not bound by traditional journalistic ethics; in other words, she continues to act immorally by being an activist.
Recall how MSNBC once gave in to Tom Brokaw and removed Keith Olberman and Chris Matthews from covering the 2008 Republican convention; but this year, such slanted commentators were the main people on MSNBC to cover the conventions and the election.
At least Chuck Todd attacked President Obama on Sunday on the grounds that he is making a terrible mistake in not working for a big agreement on the matter of the fiscal cliff.

Heller has some sickening rulings, however. The part about “common usage” implies that just because a firearm is unpopular, or isn’t allowed to develop due to other unconstitutional regulations, then the constitutionality of a ban holds.
It would be like banning tabby cats. Tabby population dwindles. Then there’s a federal ban on all cats a decade later. Well, when Kittens vs US goes to court, and the federal ban on all cats is overturned, it doesn’t help tabbys, since they’ve been outlawed for decades and aren’t in common ownership anymore. So somehow, it legalizes prior unconstitutional actions.

The update concerning Don Lemon is incorrect. The contiguous state law has been misinterpreted. It is a permissive law rather than a prohbitive. The ATF has sent out numerous point papers and interpretations on this. There is nothing in Colorado law that states ONLY residents of those states may purchase long guns in Colorado. Many states passed these clauses after the Gun Control Act of 1968. The passage these laws referenced has since been removed. The states that passed these laws did so in order to permit a wider range of areas to purchase weapons…NOT TO RESTRICT where weapons could be purchased. The NSSF is incorrect and as they are not a lawmaking body, their opinion holds not weight.

Colorado specifically defines contiguous as “sharing a border”. Otherwise, yes, you would be correct.
As is, there’s a reason I didn’t post it the same way as the Gregory piece. Lemon may have been legal, depending on his residence. But it goes to show how there is a byzantine labyrinth of gun laws that is very easy to violate – and for those who want more gun laws, they should perhaps look at how many are already there.

Don Lemon says, “It took me longer to get the identification that I need to buy that gun than did for me to buy the gun, and the ammunition. It took me 20 minutes.”
All that tells me is the DMV continues to be a clusterfark of inefficiency. If he was buying any other product at any other store I’m guessing he’d be praising the quick and efficient customer service he received instead of complaining about it.
I find it amazing that after 911 and OK City, every State, Local and Federal building was reinforced and armed security, was installed with metal detectors to protect the occupants. These are all the “good guys” and many of the employees have CC permits. Regarding the Lemon thing, you are overreaching. The purpose of “sell or deliver a rifle or shotgun to a resident of a state contiguous to this state” is to prevent sales to residents of states adjacent to Colorado. Last time I looked, Georgia is not adjacent to Colorado. Lemon is still a knucklehead, but you don’t want to join him by reading too much into state laws.
Read the simplified version of the NSSF’s laws. It’s not to prevent sales to neighboring states – in includes them, it’s that Colorado only allows sales to neighboring states. Thus, if he still resided in Georgia (or hadn’t completed CO residence requirements yet), he’d be disallowed from purchasing a long gun in Colorado.
Since they are both big shot progressives, they support and there must be, Zero Tolerance for violations of gun laws. Fine ’em the max, lock ’em up, and throw away the key.

It’s amazing how many clueless people exists in America. Federal law allows you to transport any lawfully owned gun or magazine through any state regardless of local laws. The only requirement is they must leave the state within 24 hours of entry. I do this all the time with magazines exactly like the one in question. I also have transported my fully automatic machine gun through D.C. on many occasions on my way to shoot in a Virginia gun range. Now for this there is a federal form notifying the ATF that a machine gun i s crossing state lines that must be filed and approved prior to transport, but these can be made good for a month. It is quite possible that David Gregory legally held that magazine in Washington, D.C.
You’re referring to the Firearms Owner Protection Act of 1986, correct? It allows you a peaceable journey. If you’re going from Vermont to Georgia, you’re safe in the states in between, but you’re only covered if you’re traveling.
If you live and work in DC and go waving around an illegal item, nope. And MG laws are a bit different – but that’s not what he has here.
All he has to do is say he was transporting it to his friends house, grandma'[s house, or whatever, then kept it overnight in D.C. and used it to illustrate a point on the show. In that case he will be legally in possession of it in D.C.. The federal law allows considerable leeway, you do not have to be strictly traveling nonstop through the state. As much as I dislike this idiot (Gregory) there is no reason or cause to hang him on this one. Liberals, who tend to live in big cities, need to gain a little perspective on the gun rights issue. There are many people who live in rural areas that do not have any police protection nearby. They need to be able to defend themselves from the inevitable psychopaths in the world. This right is God given and no matter what you may think or feel they have a right to self-defense. Even in a big city, the police can not and do not claim to be your protector, this is one reason why the fraternal order of police is 100% in favor of lawful Americans owning and carrying guns. The incidence of crimes committed by lawful citizens using legally obtained guns is minuscule, and there are infinitely more cases of these lawful guns being used to defend the good guys from the bad guys. The argument over so-called “assault weapons” is so pointless and misunderstood by most anti-gun people. Technically, most kids .22 rifles are assault weapons. I could take any weapon with a magazine capacity of not more than 10 rounds and do just as much damage with it as someone with an “assault weapon”. I have many guns, some considered assault weapons, some not, I can do just as much killing with any of them. I had a home invasion just over 5 years ago. With my son in the room I went to the safe and grabbed an “assault weapon” and a handgun with a large capacity magazine, they each have their strengths for defending my home and family. Fortunately, I did not have to fire a shot, but in the event I did I wanted to have my choice in defense weapons. No one else should be able to tell me I can or can’t use. Why should the criminals have their choice and me not? Any reasonable person that actually looks at and considers the data on gun possession, ownership, and use in crime or defense can only come to the conclusion that all the anti-gun, liberal arguments do not hold up against the facts. They make emotionally charged, baseless accusations about guns that are not backed up by any facts whatsoever. The problem in this country is a cultural one, but not a gun culture one. We need to face the real reasons why we have so much violence in this country. There is no evidence that point to guns being the issue. In fact, they are quite the opposite and very much part of the solution. Wayne LaPierre makes a very fact based, astute comment when he says, the only thing that will stop a bad guy with a gun is a good guy with a gun. This is true in so many ways that are backed up by facts and figures. Like I said, any reasonable person that honestly examines the issue, all emotions aside, will realize that.
BTW Shortimer , the magazine he has in hand is exactly what I use with my machine gun. I am telling you, as much as I would like to see his ignorant tukus in jail, he likely broke no laws.

It is EXTREMELY important that we follow up these blatant violations of Colorado’s and national gun laws and see that these criminals are punished to the fullest extent of the law. $1000 and a year in jail should help others to see the seriousness of these offenses. It needs to be demonstrated that all men are equal before the law. If Joe Schmoe down at the barber shop had violated these laws, he should expect the same treatment. I will be in contact with the CO Attorney General to see that these laws are enforced. Time to “lawyer-up” Mssrs. Lemon and Gregory.

I would have expected a little more fight from LaPierre. As in Gregory’s kids go to Sidwell Friends which ADVERTISES 11 person staff of security (not including secret service). It’s not like the NRA didn’t know the arguments he would throw out.
What it really means is that we already have so many crazy gun laws on the books right now, that people are already in violation every day, innocent people, with no malicious intent, so why complicate things with even more absurd new laws? Google 3 felonies a day and read that, then go turn yourselves in, because these days everybody is guilty of something, especially Obama but for some strange reason he always gets a free pass. Why is that?

Quick read of the CO statute indicates to me that it’s the SELLER who is responsible for compliance with the law? “It is declared by the general assembly that it is lawful for a licensed importer, licensed manufacturer, licensed dealer, or a licensed collector (licensed under the federal “Gun Control Act of 1968″)” Is he one of those, or are you calling for the FFL holder to be prosecuted?

I recently had to deal with a similar issue in a state that had repealed its “contiguous states” provision, and it took a while looking up laws and calling the ATF to figure out what the law was.
What might be a better solution is to look at the laws themselves, how inconsistent they are, how we know madmen won’t follow them – and we know the ATF in Phoenix sure doesn’t or Brian Terry and Jaime Zapata would be alive today.
Gun laws aren’t the answer. Dealing with actual criminals – people – is the answer.

But are David Gregory and Don Lemon the type of persons that these laws were written against? Are these people being snared by these laws in contravention to their intended meaning?
This is what we, as firearms rights activists, have been complaining about for decades. The patchwork laws that ensnare those who have no intent to do harm nor any intent to break the law. We tiptoe around these laws every day.
I went to CA a nearly decade ago and we took my Father-In-Law’s Beretta 92FS 9mm handgun which had a magazine of 15 rounds. I went to a range, without my F-I-L, with a guy I knew and while there we traded firearms to try them out. He stated “I knew you couldn’t leave this state without breaking the law. Since your F-I-L isn’t actually present, you are not allowed to let anyone else use this firearm.” So there I was, having no intent to break the law or knowledge of this passage which made me in violation. It is insanity.
This petition to have these guys prosecuted is merely an attempt at a malicious prosecution by those who want to punish their opposition. We would do better to inform these men of their acts and try to bring them about on their opinions of these laws and how they, themselves, have now become ensnared in them.
The intent is to illustrate the hypocrisy of those calling for more firearms laws when they don’t even understand them.
It doesn’t matter “who these laws were written against”. We don’t write bills of attainder persecuting one group – that’s one of the problems with gun control.
I’ve noted before that Don Lemon has had gun laws written against “his type of people”, as most gun laws are rooted in racism.

Laws are impartial and justice is blind. If we start saying “these aren’t the people we want to arrest”, then the law has no meaning. Then the poor black kid who lives a block away goes to jail, but Gregory does not? The mexican from Greeley, CO, who busted his ass to naturalize goes to visit family in south Texas, buys a gun, and gets prosecuted because of a Colorado law, but Lemon doesn’t get investigated?
If we look at these two examples and say “these laws are horrible, inconsistent, do nothing, and need to be removed and we should prosecute people for real crimes”, then there’s a point.
What would have been more effective than anything else would have been an exchange between LaPierre and Gregory which went something like this:
LP: You are stating that what you are holding in your hand is a high capacity magazine?
DG: Yes.
LP: Are we currently within the boundaries of Washington, DC?
DG: Yes, you know that.
LP: Where did you get it?
DG: What does that matter?
LP: Because you, merely holding it in your hand, with no ammunition, no firearm, and in the boundaries of this city have committed a crime for which you can be punished by law with a $1,000 fine and up to one year in jail. You, at this time, in this place are committing a criminal act under DC statutes. How does it feel to be a member of the criminal class for being ensnared by a law which you likely do not even know exists? That, as firearms owners , is what we go through every day and you want even more of these laws?
Gregory should be banned for hypocracy, and stupidity.

The framers of the Constitution and Bill of Rights didn’t write the BoR with the 1st and 2nd Amendments at the head of the list just to fill in time,they lived under the thumb of oppression without those two rights.

Richard, where does the second amendment place any restriction on the type of gun that is included? It does not. These games of continually eroding our 2nd amendment rights just keep going further and further. You young folks may not see this as clearly, but this is how the liberal takeover has been played, they make a push for restrictions and new laws, you give them an inch, they try to take a mile. Then when things settle down a bit they conjure up another argument to take another inch. Of course they always use arguments that appeal to non gun owners, but simply have no basis in real world facts and their arguments do not hold up against any logic, but they keep it up year after year. They will not be happy until no one has a gun except the criminals, then they will go forward unimpeded with their tyranny since no one can stop them. History is full of these examples and if you think we are immune to that happening here in the USA you are dead wrong. There are many people in the world who would love to take this country and its people down. I believe they are dominating our press and politics this very day. They must be stopped. Since when do gun laws matter to conservatives? If you had it your way people could carry any weapon and any amount of ammunition they wanted anywhere. The REAL issue here is that Gregory doesn’t share your views and yet went on and broke the law. I’ll grant you that.

Gun laws matter in the form of what’s in the Bill of Rights.
The ones on the books are there to be followed as constitutional or opposed in court as the unconstitutional statist creations they usually are – as done in Heller v DC or McDonald v Chicago.
