ALBANY, N.Y. (AP) — Days after calling for an overhaul of gun control in New York following the Connecticut school shooting, Gov. Andrew Cuomo worked out a tough proposal on gun control with legislative leaders who promised to pass the most restrictive gun law in the nation.
“It is well-balanced, it protects the Second Amendment,” said Senate Republican leader Dean Skelos of Long Island. “And there is no confiscation of weapons, which was at one time being considered.
Lie lie lie lie lie.

Cuomo said he wanted quick action to avoid a run on assault rifles and ammunition as he tries to address what he estimates is about 1 million assault rifles in New York state. He made it a centerpiece of his progressive agenda in last week’s State of the State address.
The progressive need to act fast to squash citizens’ rights before they can respond is there. Interesting how there are 1 million rifles, yet no one does anything with them. It’s a testament to the peacefulness of the people. And it may also be a testament to their passivity if they turn them all over.
Republican Sen. Greg Ball called that political opportunism in a rare criticism of the popular and powerful governor seen by his supporters as a possible candidate for president in 2016.
“We haven’t saved any lives tonight, except one: the political life of a governor who wants to be president,” said Ball who represents part of the Hudson Valley. “We have taken an entire category of firearms that are currently legal that are in the homes of law-abiding, tax paying citizens. … We are now turning those law-abiding citizens into criminals.”
Ayn Rand already explained this years ago:
There’s no way to rule innocent men. The only power government has is the power to crack down on criminals. When there aren’t enough criminals, one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws.
And now there is no resistance to the state. The purpose of the Second Amendment was to constrain government in the most physical sense. NY has declared physical power illegal; in Maoist terms they know that they will be the only ones with the guns – so now they have the power.
There’s one other thing in the story very much worth noting:
The legislation also increases sentences for gun crimes including the shooting of a first responder that Cuomo called the “Webster provision.” Last month in the western New York town of Webster, two firefighters were killed after responding to a fire set by the shooter, who eventually killed himself.
Remember this? Guns have little to nothing to do with that crime. To quote myself:
The murdering waste of life who ambushed four volunteer firefighters, killing two, in upstate New York had spent 17 years in prison for beating his grandmother to death with a hammer and was paroled.
He beat his 92 year-old grandmother to death with a hammer and was let out of prison.
That isn’t about guns. That’s about a leftist-progressive legal system that lets a murderer go free to murder again. The state of New York released a murderer and when he killed again, they used the murders that they allowed to happen as another pretext for more attacks on citizens.
The text of the New York bill can be found here. But a quick summary would be this on ammo:
- All ammunition purchases have to be through an FFL
- Ban on internet ammunition purchase
- Background checks for all ammo purchases
- All sales of ammo to be reported to police
And this on guns:
- Ban on magazines that hold more than 10 rounds made before 1994
- Ban on magazines that can hold more than 7 rounds
- “Grandfathered” 10 round magazines cannot be loaded with more than 7 rounds – or face charges
- Registration for all “assault weapons”
- Registration for all handguns
- Registration required every five years
- Mental health reporting which is to be checked against a non-existent database on citizens
- One-feature test for “assault weapons” (no detachable magazines, no pistol grips, no threaded barrels – as written includes adjustable choke shotguns)
- Bushmaster AR banned by name
Also, “assault weapon” possession in NY is now a Class B felony. Possession of an actual machinegun is only a third degree Class D felony. An evil scary non-machinegun can get you 25 years. A real machinegun can get you 7.
Update: From the NY Times:
The guns package was negotiated privately by the governor and legislative leaders over the last several weeks, but was only completed late Monday; rank-and-file Senators had only a few minutes to read the legislation before voting on it. Mr. Cuomo, saying, “If there is an issue that fits the definition of necessity, I believe it’s gun violence,” waived the normal three-day waiting period between introduction of new legislation and a vote.
Gotta do it fast, right now, before anyone has any time to say anything about it or question it. That’s how burgeoning dictators work.
Well, the Empire state sure is acting imperial. People get the government they deserve.
